Facebook insider Moskovitz still unloading IPO stock daily

Nine business days, 1.3 million shares sold

As previously reported, Facebook co-founder Dustin Moskovitz disclosed on August 24 that he had sold 900,000 shares of Facebook stock over the six business days following the "lockup" of the stock awarded to him during the IPO. According to filings with the Securities and Exchange Commission (SEC) he has been continuing this trend, and has shed another 450,000 at a rate of 150,000 per day from Monday through Wednesday.

Including the sales through Wednesday, he still owns more than 130 million shares of the company. The Wednesday disclosure, mandated by SEC regulations, showed he sold the most recent batch at prices between $19.00 and $19.49 per share.

Companies generally impose "lockup" status on insider shares for three months to a year after an IPO to regulate the release of shares on the free market to prevent exactly what's been happening to the share price. Market capitalization has dropped to $42.6 billion since the IPO. The lockup expires on a group of 1.22 billion IPO and founder shares on November 14.

Facebook stock hit a record low on August 17, sinking to just over half the IPO price, as insiders and the first investors in the company became eligible to unload the shares locked up by federal trading restrictions since the commencement of sales. Experts said in response to the drop that the value of the stock and company could plummet further if early purchasers and employees saturate the market with their shares of stock as more lockups expire before the end of the year.

Google Now update brings sports, movies, storm warnings

If you're lucky enough to have a phone running the latest version of Android, an update to Google Now is rolling out Wednesday?that lets you check movie times, receive?emergency alerts?and get the latest scores from the ballgame.

The Google Now service gives personalized capsule responses to common queries about current and local events. The feature was announced in June, but there are still new "cards" (as the special search results are called) being developed.

The latest update brings some extremely practical new cards to Android 4.1 users. One card brings up local movie showtimes, which is probably what you're looking for if you search for a theater or film on your phone. Another (just in time for Isaac) allows emergency messages like storm warnings and earthquake alerts to be pushed to your phone.

And to the delight of many sports fans, another card lets you keep up to date with any of 140 soccer, football, hockey and baseball teams. You can select your favorites from a list or search for them, and can then choose to receive news?before, during?or after games (or all three).

If you're running Android 4.1, you can download the improved?app via the Google?Play Store, or very possibly your phone has already detected that the update is ready and will download it automatically.

What Happens When Wives Go On Strike: The Experiment That Went

As a mother of 3 and wife to 1, ?I do it all. I wash (and fold) multiple loads of laundry every day, I wipe?snotty noses all day long, I referee fights, I pay bills, I negotiate contracts, I register the kids to school, I?coordinate multiple doctor?s appointments and I even act as a consultant when a family disagreement comes about. I literally do it all?and many times without a simple, ?thank you? from my family.

Just the other day, I was so exhausted that after work I decided to go upstairs to take a nap. As I went upstairs, ?I noticed there were dishes in the sink. ?However, there are at least two other capable people in the house who could take care of them?or so I thought. When I awoke from my nap, I went downstairs to start dinner but as soon as I crossed the threshold I was greeted with a nightmare. There were even more dishes piled up in the sink (some not even rinsed off), there were open containers of food scattered across the counter tops and someone had the nerve to load the trashcan with more trash without even pushing it down.

Needless to say, I LOST it. I caused so much commotion, that my entire family scattered in fear that World War III was about to erupt. I was so freaking angry at everyone in my family. WHY do I have to clean up when there are at least 2 other people who can significantly contribute to the upkeep of the household? Who puts more (stinkier) trash on top of trash with out taking it out? WHO thought it was a good idea to open food and then leave it on the counter? WHO?

You see even though I was pissed about how my kitchen looked, I was more pissed about how my family (at times) does not exercise thoughtfulness when it comes to me. They ASSUMED that all because my title is MOM that I want to be a full time housekeeper for them.

They are dead wrong.

Even now when I think about it now I get mad as hell. So to show them that they need to respect what I do around the house I decided to go on strike after that incident.

No, I didn?t go and get a sign and start marching. ?I did something more subtle, yet effective. I refused to cook/clean/be concerned for ?4??straight days. I did not even look at their endless laundry, instead I simply washed my clothes and dried them. When they needed something clean, I deferred all decisions to their Dad. Instead of cooking, I ate ?take out ? every day and left the receipt for my husband to see. ?More importantly, I didn?t clean any bathrooms, kitchens, or common areas for 4 days straight. In addition, I only made lunches for myself and I definitely didn?t suggest solutions for ?any common household problems.

I was on strike!

Before I tell you guys the outcome of my ?strike?, ?let me tell you how things went. Days 1 and 2 were easy? I got take out for me, while I watched my family struggle to do all of the things that I normally do. I went to bed early and even had time to read a book before dozing off. However, days 3 & 4 were hard. My kids looked helpless and my poor husband looked like he was about to ?crack under pressure?. By the end of day 4, I decided I couldn?t let my family suffer any longer? I rightfully took my place back as doctor, referee, negotiator, and general awesome mom. After I put everything back in order, ?I was still a little upset about not being appreciated until my husband said, ?You know what babe..I don?t know what we?d do without you.? Just him saying those words made me feel appreciated. So for now, I?m not going to go back on strike. ?But I now know what to do to prove my point!

Ecuadorians rally around decision to offer asylum for Assange (+video)

Britain's forceful demands on Ecuador over Julian Assange, the founder of WikiLeaks, has rallied Ecuadorians around their country's decision to grant him asylum.

In the letter, technically an?aide memoire in diplomatic speak,?the UK government explained that it has the right to enter Ecuador?s embassy if the Ecuadorean government were to decide to grant asylum to Mr. Assange, the founder of the antisecrecy group WikiLeaks.?

The letter was seen as a direct ?threat? to the country, said Mr. Pati?o.??We are not a British colony,? he said. ?The days of the colony are over.?

This decision rallied support among Ecuadorians towards the decision ??formally announced today ??to grant asylum to Assange. Some hardliners, supporters of President Rafael Correa, protested outside the UK embassy in Quito on Wednesday night, while others cheered when Pati?o officially announced Ecuador would grant Assange asylum in an early and longwinded press conference on Thursday.

For common people in Ecuador, it was good for their country to stand up against larger countries.

?The way the UK expressed itself was almost violent,? says Pablo Boada, a cultural consultant, reached by phone in Quito?s old town.??It awakened my sense of solidarity towards the Ecuadorean state as a whole."

As Ecuador is about to enter an election cycle, this sense of solidarity could well be harvested by President Correa, who is most likely going to run again for president in February 2013.

According to government sources who spoke to The Guardian earlier this week, the Ecuadorean government had already reached an agreement with Assange when the WikiLeaks founder decided to enter the embassy in London on June 19, officially asking for political asylum.

But despite this, authorities seemed surprised by the British reaction, and acted immediately to respond to what they saw as a ?threat.?

?Nobody is going to intimidate us!? Correa tweeted.

For many abroad, who have read about Correa?s difficult relations with media this year, it might seem ironic that he is granting asylum to Assange in the name of freedom of expression.

In April, Assange conducted an interview with Correa for his TV show on Russia Today, a Russian state-funded channel in English, and the two joked about issues such as freedom of speech.

?Cheer up! Cheer up! Welcome to the club of the persecuted!" said Correa, who believes Assange should be granted political asylum because he is being politically persecuted.?

In recent years, WikiLeaks has begun publishing huge volumes of classified US military and diplomatic documents. Sweden, meanwhile, is seeking Assange's extradition in order to question him about sex crime accusations made against him. Some of Assange's supporters fear Sweden would give Assange over to the US, however experts note it would be simpler for the Americans to just extradite Assange from the UK.

In Ecuador, some within the business community are simply worried about their livelihoods.?Some businessman saw the decision as a threat to Ecuador?s trade relations.

?My worry is that we can be seen as an unfriendly country,? says Javier Mu?oz, who runs a car import business in Quito and was reached by phone.??If Ecuador starts fighting with these countries, this could have a very negative effect for everyone."

The United States is Ecuador?s main trade partner. Long-time US trade benefits with Ecuador, under the Andean Trade Preferences Act, are up for renewal this year. Businessmen like Mr. Mu?oz are worried that the US Congress might decide not to renew the preferences following the Assange decision.

However, it is unclear whether anything ultimately comes of Ecuador's decision.?

Today the British Foreign Secretary said the UK does not recognize the principle diplomatic asylum and would not allow Assange to leave the country.

It might remain little more than a symbolic gesture for Ecuador, but a symbolic gesture that might have repercussions.

Colorado shooting victims' families blast fundraising charities

AURORA, Colorado (Reuters) - Families of people killed and wounded in a shooting rampage inside a Colorado movie theater in July said on Tuesday they were being denied a voice in how $5 million in donations raised to help them was being dispersed.

Tom Teves, whose son Alex was killed, said the first disbursement of funds went to various charities instead of victims and that a committee charged with distributing the money does not have any victims or their families on it.

"We are certain that everyone who donated their hard-earned wages intended for 100 percent of their donations to go directly to the victims," Teves said. "Unfortunately, it does not seem to be the case."

In an emotional news conference, 18 people representing families of the 12 who were killed and 58 who were wounded in the shooting accused some charities of soliciting funds by using victims' photographs without permission.

The Community First Foundation said $350,000 had been given directly to the victims or their families. The foundation, which manages the Aurora Victim Relief Fund, said it was dispersing money through smaller local charities that are responsible for distributing it to victims and their families.

Teves said $5,000 was given to each of the 70 victims' families only after they threatened to make public their concerns.

"The victims of 9/11 had similar issues with non-profit organizations keeping the donations from directly going to the victims until a handful of families put a stop to it," Teves said.

Community First's Executive Vice President Cheryl Haggstrom said, "We don't have direct communication with the families, but have been relying on professionals from police to the district attorney's office and victim advocates for them to tell us when it's the best time to include them."

She said the foundation was in the process of arranging a meeting with victims to get their input.

Former University of Colorado graduate student James Holmes, 24, is accused of opening fire inside the theater in Aurora on July 20 during a midnight screening of the Batman movie, "The Dark Knight Rises". He is being held in solitary confinement and without bond in the Arapahoe County jail.

U.S. Navy veteran Josh Nowlan, 32, who was severely wounded in the shooting, said he was slowly recovering but added that he knows families of those who died were suffering. "If I was a millionaire, I would give every dollar of it to them," he said.

Britain said on Sunday it remained committed to reaching a diplomatic solution to the presence of WikiLeaks founder Julian Assange in Ecuador's London embassy, after both countries took steps to defuse a row over his action in taking refuge there.

Assange has been living in the embassy's cramped quarters for more than two months since fleeing there to avoid extradition to Sweden, where he is wanted for questioning over rape and sexual assault allegations.

The Latin American state's leader said on Saturday that Britain had withdrawn a threat to enter the embassy to arrest Assange, to whom Ecuador has granted asylum, and that he now considered the "unfortunate incident" was over.

President Rafael Correa was responding to a British assurance that it was not threatening the embassy and that Britain was committed to the Vienna Convention, which protects the inviolability of diplomatic premises.

"We remain committed to the process of dialogue we have entered into and we want that to resume with the government of Ecuador," a British Foreign Office spokeswoman said.

Britain provoked a furious reaction after telling Ecuador that an obscure British law allowed it, under extreme circumstances, to remove the embassy's diplomatic status, exposing Assange to immediate arrest by police.

Ecuador accused Britain of planning to storm the embassy and demanded it withdraw the threat.

Britain said it had not meant to threaten Ecuador, a plea that fell on deaf ears, prompting it to send Ecuador a formal communication on Thursday confirming that the embassy was safe.

The communication was copied to diplomats at a meeting of the Organization of American States (OAS) in Washington on Friday which discussed the spat.

A British diplomat attending the meeting invited Ecuador to resume "constructive discussions" on Assange, the Foreign Office said. "We believe that our two countries should be able to find a diplomatic solution," the unnamed diplomat added, according to a transcript issued by the Foreign Office.

Britain says it is determined to fulfil a legal obligation to send Assange to Sweden.

As businesses rely more heavily on their data center services, the cost of downtime increases. And for these (and other) businesses, hurricane season is a strong reminder of the need to plan ahead for potential disasters. One disaster recovery option for companies is a remote facility that can take over operations in the event that the main facility suffers a downtime event. But is such a strategy cost effective?

Evaluate the Cost of Downtime

The answer to the question ?Is X worth it?? is almost invariably ?It depends.? The case of disaster recovery data center sites is no different. For one company, a remote disaster recovery site might be worth every penny of the expense, and then some; for another company, it might be a cost-prohibitive option that cannot be reconciled with the current (or future) financial situation. The first step in determining if a remote site?or any other part of a disaster recovery plan?is worth the cost is to evaluate the cost of downtime. This is a topic that could be discussed at great length, but the following are a few considerations to examine when determining this cost to your business.

  • How much direct income will you lose if your data center fails? This is the most obvious cost: if your data center is part of your link with customers, then downtime means lost revenue.
  • How much employee time will be redirected from productive efforts to recovery efforts following a downtime event? Every man-hour spent fixing the problem is a man-hour not spent developing new products, providing services to customers or otherwise building the company.
  • How will downtime affect your company?s reputation with existing and potential customers? A poor reputation for reliable service means customers will go elsewhere. Will a disaster that takes down your data center be something your business can recover from? Or is ongoing service continuity a requisite for success?
  • How much will emergency services and equipment cost your company? Getting your data center back online after a disaster can be very expensive if you try to do it quickly. Emergency service is expensive, and getting replacement parts or devices in short order can also carry greater cost.

Again, these are just a few considerations. And how each company evaluates its potential losses owing to downtime will vary by industry, clientele, criticality of services provided and so forth.

Once you have determined a working number regarding downtime cost (say, dollars lost per minute or hour of data center downtime), you will be in a better position to evaluate disaster recovery options, such as remote sites.

Benefits of Remote Disaster Recovery Sites

In the event of a major disaster, all your efforts at redundancy, data backup and so on to keep your data center running may be in vain. A hurricane, for instance, might knock out utilities such as power and water for an extended amount of time, and they can even cause significant damage directly to your facility. Even worse contingencies are certainly conceivable. One logical option to circumvent the risks to your business is to build a remote disaster recovery site: another data center that can take over operations if your main site goes down for some reason. Locating the backup site remotely reduces the risk that a disaster affects all of the company?s data center resources simultaneously, enabling continuous service to customers and to the company itself.

Costs of Remote Disaster Recovery Sites

The costs associated with a remote site vary depending on the type of implementation: obviously, for instance, a full company-owned data center will involve much greater capital cost than a colocation-based implementation. In the former case, all the same costs associated with building a data center apply, ranging from real estate costs to construction, IT equipment and personnel costs. Colocation implementations are less, but they still involve capital costs for the IT equipment as well as ongoing charges, even if you don?t run most or all of your equipment.

Costs will vary depending on the distance of the remote site from your main site. Disaster recovery sites should be far enough away from the main site such that a single disaster has a low probability of affecting both locations (and that probability depends on the kinds of threats present in the particular area). On the other hand, locating a remote site too far from the main site has its own difficulties: moving staff to the backup site can be burdensome or even impossible, but maintaining remote staff can be expensive.

The question is then whether the cost of downtime at your company?s main facility can justify the cost of constructing and maintaining a remote disaster recovery site. For many small or even medium-size businesses, the answer may well be a resounding no. Nevertheless, for many other companies, the potential returns from maintaining a remote site may well outweigh the costs of downtime. Again, the answer to the question of whether a remote site is worth the cost depends on the situation each company faces: there is no universal ?yes? or ?no? answer to this question. Furthermore, even the ?yes? option raises a number of possibilities for the remote site, ranging from how it is operated to what kind of facility it should be.

Alternatives to a Traditional Disaster Recovery Site

Even if your business necessitates a remote disaster recovery option of some sort, you are not locked into buying land, building a brick-and-mortar data center of your own and then staffing it with personnel ready to take over operations at a moment?s notice. A number of alternatives can help you reduce cost and still gain the protection of a backup facility, should disaster strike. More parents of special-needs children opt out of ... - Education ...

For thousands of Texas parents, the start of the school year has taken on a new meaning: an end to the conflicts, struggles and disappointment with the public school system.

A growing number of parents of special-needs children are opting out of public schools, deciding instead to home school or to pay for pricey private schools.

The number of secondary students who left public schools to home school increased 50 percent from 2003 to 2010, reaching 2,040 7th- through 12th-graders, according to the Texas Education Agency. The number of middle- and high-school special education students who withdrew for private school increased 75 percent, reaching 772 in 2010.

That?s not to mention thousands of younger students whose reasons for leaving public schools aren?t recorded, or the countless families who give up on public school before their child receives a needed ?special education? classification. With Texas? diagnosis rate falling to an all-time low of 8.8 percent in recent years ? the lowest in the nation ? the label and its accompanying services are harder than ever to come by.

?It?s the free market at work. People are voting with their feet,? said Tim Lambert, president of the Texas Home School Coalition. ?Parents just get frustrated with the bureaucracy of the public school.?

A record 300,000 Texas children are being home-schooled, and an increasing number of them have special needs, prompting the creation of support groups and specialized curriculum. Some families who don?t feel equipped to handle home-schooling a child with special needs search out one of the dozens of specialty private schools, often paying the equivalent of Ivy League tuition.

Leslie Phillips pulled her son out of a Katy school when he was in second grade, opting to pay a $30,000-a-year tuition bill rather than continue fighting for the services she felt he needed. The family viewed tuition as a better investment than a legal battle they were unlikely to win. To add urgency, her son, who has an autism disorder, was coming home with bruises that no one could explain.

Lack of resources

?They just didn?t or couldn?t respond quickly enough to get us in a situation that was safe for him,? said Phillips, whose son, now 12, is thriving at a private school. ?I have probably more sympathy for school districts than many parents. ? They?re left with this explosion of children with a high level of need and they can?t scramble fast enough to get the resources and training.?

Considering the autism and attention deficit-hyperactivity disorder epidemics, Texas? shrinking number of special education children seems questionable, she added.

Some education officials, however, argue the decline is a positive sign that public schools are identifying and remediating learning disabilities faster, reducing the need for special education.

Cynthia Singleton home-schooled her son, who has autism, for several years before enrolling him in Johnston Middle School in the Houston ISD, where he?s an eighth-grader in advanced classes. It?s the lack of attention to the social needs of special education students that will likely leave her scrambling for alternatives for high school.

?They don?t have even half of the resources they need to handle the kid with disabilities,? she said. ?They turn a blind eye to the social needs.?

A niche group of lawyers defends school districts against parents? special-education legal claims, making it difficult for parents to prevail without spending considerable time and money.

?Find an alternative?

?When you get into a fight with a school, it?s like a divorce,? Singleton said. ?I?d rather take my energy and money and find an alternative.?

Claudia Wanczyk pulled her son out of Katy ISD when he was rezoned to a different school with a new teacher at the start of fourth grade. The family has spent thousands of dollars on therapy in addition to home-schooling the 12-year-old.

?He?s made more progress? at home, she said.

Rebecca Rex?s son is starting Lone Star College this month after being home-schooled throughout K-12. She showed up for kindergarten registration 15 years ago intending to enroll him in public school, but she had immediate concerns about administrators? reaction to her son, who was born with lead poisoning.

Rex?s son is now an avid photographer and a skilled swimmer. He?s well traveled and a talented artist.

?It just became a way of life for us,? she said. ?I guess I?m happy the school system ran me off, to be honest.?

Former stay-away Tevez wants to extend City deal

Carlos Tevez, the Manchester City forward who spent much of last season refusing to play for the club, now insists he wants to stay with the Premier League champions beyond the two years remaining on his current contract.

The Argentina striker's impressive form continued at Liverpool where he scored City's second goal, following an horrendous error by home defender Martin Skrtel, to secure his side a point in a 2-2 draw at Anfield on Sunday.

This time last year, Tevez was about to stage his notorious 'strike' in which he refused to play for the club following a disagreement with manager Roberto Mancini during a Champions League tie at Bayern Munich.

But having spent much of last season in his native Argentina, Tevez returned to England and helped City to the title.

Now, the forward claims he will not only see out his remaining two seasons but would consider playing for the Eastlands club beyond that.

"Yeah, I'd have no problem staying," said Tevez. "I have two years on my contract and, yeah, I could stay longer.

"The new season is good for me. I have lost seven kilos (15 pounds), so that's good for me and the club. Last year was difficult for me. After I came back, I played and we were champions. That was the best bit of last season.

"A year ago, was the most difficult bit. Now is now. The problems of last season are finished. Now I'm happy, Roberto is happy, the club is happy. The problem is finished.

"I play all the time for my family, my father, my mother, my brothers and sisters in Argentina. It is difficult for me because they are in Argentina, but this is my job and I like football."

Tevez was gifted his equaliser -- his 100th goal in English football -- thanks to a dreadful slip and back pass from Skrtel, which completed the scoring after Skrtel himself had headed an opener.

Skrtel's goal was equalised by Yaya Toure before Luis Suarez restored Liverpool's lead from a well-struck free-kick.

"Carlos is on good form at the moment and I'm happy for him," said Mancini. "If he plays like that of course he can stay ... sure!"

Liverpool manager Brendan Rodgers, still searching for his first league win as Reds boss, backed Skrtel, despite his error.

"I commend Martin's courage," he said. "The easiest thing is to smash the ball up the pitch, then they have it back and they're on the attack again.

"It was a wonderful header for our first goal and he has been a real stalwart all the time I have been here," the former Swansea boss added.

With only five days remaining in the transfer window following the game, both managers also revealed they expect to be busy in the coming days although they each insisted City's reported interest in Liverpool defender Daniel Agger is at an end.

"Daniel was never for sale anyway," said Rodgers. "Daniel likes playing for Liverpool, I wasn't wanting to lose him. That's the end of it."

While Rodgers claimed he was "hopeful" of signing new talent, Mancini seemed far more desperate to add to a squad which he has long since claimed is not deep enough to challenge for the Champions League.

"I need to bring players in," Mancini said. "We have worked for this and now we have five days to do it.

"We should work hard," the Italian added. "It is going to be a long week. We have our targets and I hope we can close them in the next five days."

Swansea midfielder Scott Sinclair remains strongly tipped to move to City before the window shuts on Friday.

Apple wins $1 billion victory over Samsung

In a verdict that would have warmed the heart of the late Apple CEO Steve Jobs, a federal jury on Friday handed Apple a resounding legal victory in its bitter patent war with Samsung, ordering the South Korean tech giant to pay more than $1 billion in damages for "willfully" copying the iPhone and iPad.

Legal experts say the jury's finding of willful infringement enables Apple to seek to triple the billion-dollar damage award, already believed to be an unprecedented judgment in a patent trial. The verdict also sends a threatening message to Samsung and other Apple competitors in the mobile-phone and tablet industry that use Google's Android operating system, potentially making it harder for them to compete with the

Cupertino-based tech giant in the multibillion-dollar industry.

Ticking off one by one the findings in a 20-page verdict, the jury said that a wide range of Samsung smartphones and its Galaxy tablet trampled on Apple's patent rights. The jury in particular found Samsung's Fascinate, Epic 4G and Galaxy S II smartphones were rogue products that warranted more than $100 million each in damages for copying the iPhone, although the panel spared Samsung much punishment for infringing the iPad.

At the same time, the jury rejected Samsung's counterclaims that Apple infringed some of its wireless technology patents. The jurors, who reached a verdict on the third day of deliberations, fled the courthouse without speaking to a throng of reporters.

Legal experts were quick to say Apple got just about everything it could want from the much-anticipated verdict. It was "a huge win, a crushing win," said Santa Clara University law professor Brian Love.

Apple attorney Michael Jacobs told U.S. District Judge Lucy Koh the company would move to block the sale of many of the products in the United States within seven days; she already has issued preliminary injunctions against the Nexus phone and Galaxy 10.1 tablet.

Samsung

is certain to appeal to the U.S. Federal Circuit Court of Appeals, the Washington, D.C.-based court that hears patent appeals, although legal experts say the jury decision is on firm legal ground.

"The verdict will be hard to dislodge," said Stanford University law professor Mark Lemley. "It's clear the jury took their job very seriously."

The jury's verdict was the most important milestone in the nearly two-year global war between the two tech giants over legal rights in the smartphone and tablet market. At stake is Apple's grip on the huge U.S. market and the impact of its aggressive claims that Samsung is propelling itself with devices that copy the iPhone and iPad, two of the most recognizable products ever produced.

With the U.S. marketplace key, the verdict gives Apple a leg up in a legal firestorm that has stretched from San Jose to Australia, across Europe and into Asia. On Friday, a South Korean court issued a split ruling in a similar patent fight there, siding with Samsung on some claims and Apple on others. That decision came just hours before the jury declared Apple the clear winner in the Silicon Valley case.

While the San Jose verdict was definitive, it may not settle the global smartphone war between the two rivals.

"It's a strong win for Apple, but the war between the parties will go on," said Robin Feldman, a Hastings College of the Law professor.

An Apple spokeswoman said the trial showed "Samsung's copying went far deeper than even we knew."

Samsung lamented that Apple's victory was a loss for American consumers. "It will lead to fewer choices, less innovation and potentially higher prices," the company said in a release, vowing to continue to defend itself in court.

The three-week trial gave both companies an unprecedented opportunity to tell their sides of a story that could shape their increasingly competitive relationship for years to come, and the outcome may provide the groundwork for resolution of the global legal feud.

During the trial, Apple depicted Samsung as an unrepentant copier, scrambling in the aftermath of the iPhone's 2007 release to develop products that shared the same smartphone features and could be sold at a lower cost. Samsung, Apple insisted, cheated by copying the iPhone and later the iPad, mimicking the designs so much that Google warned Samsung the devices looked too much alike.

Apple urged the jury to award at least $2.5 billion in damages for selling tens of millions of what were branded "accused" smartphones and tablets.

Samsung, meanwhile, portrayed Apple as a company trying to stifle competition by using lawyers and the courts to assert patent rights without legal justification. Samsung denied copying Apple in products such as the Galaxy smartphones and tablets, and told the jury that Apple's iPhone and iPad were part of an evolution in the industry, not the unprecedented innovations Apple made them out to be.

With the legal battle unfolding, Samsung has surpassed Apple as the top seller of smartphones internationally, while Apple's iPad has kept its lead in tablet sales.

Apple's hostility toward South Korea-based Samsung and, by implication, Google's Android operating system, permeated the proceedings.

Many legal and tech observers consider Apple's legal assault on Samsung an outgrowth of Jobs' fury over what he considered copying by smartphone rivals and Google's Android system, which runs most of the Cupertino powerhouse's competitors' smartphones.

On Wall Street, Apple shares gained almost 2 percent in after-hours trading and Google, whose Android system is used in Samsung devices, lost nearly 1 percent.

The fallout from the San Jose verdict could land in many places. The trial dealt only with an older line of Samsung smartphones and tablets, reflecting the fact that such patent feuds often lag behind the release of new technology. A second patent case is pending before Koh over some of Samsung's more recent products, with a trial date in 2014.

Apple has yet to take on Samsung's most recent smartphone, the Galaxy S III, but indicated in previous hearings that it considers that device a byproduct of previous design copying.

I have been finding that many people do not realize that there is an instant messaging (chat) feature in Gmail that lets you send and receive instant messages with other Gmail chat users. This feature is typcially turned on by default.? To make sure it is turned on, click on the gear icon and choose Settings.? Click the Chat tab to determine if chat is on or off.

Now that you have discovered Gmail chat, did you know you can send and receive SMS text (cell phone) messages using Gmail chat?

Here?s how to turn the SMS text messaging feature on:

Gmail chat lets you easily send text messages to and from cell phones. If this feature isn?t already enabled on your account, you can enable it by following these steps:

  1. Click the gear icon in the upper right, then select Settings.
  2. Select the Labstab.
  3. Scroll down until you see Text Messaging (SMS) in Chat, select Enable and Save Changes.

Here?s how to use the SMS text messaging feature, in Gmail chat, to send (and receive) text messages:

  1. Enter your contact?s name in the ?Search or invite friends? box in Chat, and select Send SMS from the box of options that appears to the right of your contact?s name. Or, if you already have a Chat window open for this contact, just click Options, and select Send SMS.
  2. In the dialog box, enter a phone number in the ?Send SMS messages to this number? field. This feature is only launched in selected countries. Click herefor the list of supported countries and operators. If you are not located in one of these countries you can still use it, but you won?t see the SMS option in Chat until you enable it manually in the Chat settings page.
  3. Click Save.
  4. A Chat window appears. Just type your message as you would normally. When you hit Enter, the message will be sent to the phone number you entered.

If your contact replies, the text message response will appear as a reply in Chat. These conversations are stored in your Chat history just like regular chats (but keep in mind that you can?t go off the record while communicating via SMS).
